Food Web Terms and Conditions

1. Introduction
Welcome to Food Web, a platform connecting commercial kitchen owners with food entrepreneurs looking for certified kitchen space. These Terms and Conditions govern your use of the Food Web platform and its associated services. By creating an account and using our platform, you agree to these terms. If you do not agree, please do not use the platform.
Food Web operates in compliance with Canadian federal and provincial laws, including but not limited to:
The Personal Information Protection and Electronic Documents Act (PIPEDA)
Provincial Health and Food Safety Regulations
Consumer Protection Laws
Contract and Commercial Agreements
These terms outline the responsibilities and rights of all users, including kitchen owners, renters, and Food Web as the platform provider.
Note on Referral Program: Food Web Kitchens operates a separate Referral Program that is governed by its own terms and conditions. The Referral Program allows users to refer kitchens to our platform and earn lifetime rewards. This Referral Program is separate from these general Terms and Conditions. 2. Definitions
For the purposes of these Terms and Conditions:
“Platform” refers to the Food Web website and any related services.
“User” refers to anyone accessing or using the platform.
“Kitchen Owner” refers to individuals or entities listing and renting their kitchen spaces.
“Renter” refers to individuals or businesses booking and using kitchen spaces.
“We,” “us,” and “our” refer to Food Web as the platform provider.
“Booking” refers to an agreement between a Kitchen Owner and a Renter facilitated through the platform.
3. Eligibility & Account Registration
To use the Food Web platform, you must:
Be at least 18 years old.
Provide accurate and up-to-date information during account registration.
Agree to comply with all applicable laws and regulations, including food safety laws.
Be responsible for maintaining the confidentiality of your account credentials.
Kitchen Owners must ensure that their kitchens:
Comply with local health and safety laws.
Are properly insured for third-party use.
Renters must:
Possess a valid Food Handler Certificate (or be working under a permitted food business).
Obtain any permits or business licenses required for food production and sales.
Follow all health and safety regulations outlined by the Kitchen Owner.
4. Booking & Payment Policies
All bookings must be made through Food Web to ensure transparency, documentation, and regulatory compliance.
Payment is processed securely at the time of booking.
Kitchen Owners set their own rental rates and terms, which are clearly displayed before booking.
Renters are responsible for ensuring the kitchen is left clean and in the agreed condition after use.
Additional fees may be charged for damages, extended usage, or excessive cleaning required.
5. Cancellation & Refund Policy
Each Kitchen Owner may have their own cancellation policy, which takes priority over Food Web’s default policy. If no policy is set, the following applies:
More than 48 hours before booking: Full refund (or card is not charged).
24 to 48 hours before booking: 50% refund.
Less than 24 hours before booking: No refund.
Why this policy?
We understand that life happens and unforeseen circumstances arise. However, last-minute cancellations negatively impact kitchen owners who may have turned down other bookings. This policy ensures fairness and operational consistency.
In exceptional cases (e.g., emergencies, extreme weather, kitchen shutdowns), Food Web may review refund requests on a case-by-case basis.
6. Insurance & Liability
6.1. Food Web’s Role
Food Web is a third-party platform that connects Kitchen Owners and Renters. We do not own or operate the kitchens listed, nor do we supervise food preparation.
6.2. Liability Waiver
Food Web is not responsible for:
Food safety violations, contamination, or illnesses.
Accidents, injuries, or damages occurring in a rented kitchen.
Regulatory compliance of either party.
Lost revenue, disputes, or business losses.
Any disputes must be resolved directly between the Kitchen Owner and the Renter.
Insurance Requirements:
Kitchen Owners must have liability insurance covering rental activities.
Renters must obtain liability insurance if required by the Kitchen Owner.
Food Web does not provide insurance but tracks and verifies coverage.
Legal & Regulatory Cooperation:
In the event of a legal dispute, Food Web will provide all relevant documentation to insurance companies or legal authorities, including:
Booking records
User agreements
Proof of permits and insurance
7. Privacy & Data Protection
Food Web is committed to protecting user data in accordance with PIPEDA and relevant provincial laws.
7.1. Information We Collect
We collect:
Personal information (name, contact details, business information).
Booking history and financial transactions.
Compliance documents (permits, insurance).
7.2. Data Retention & Sharing
Personal data is stored securely and retained only as long as necessary.
Data may be shared with regulatory authorities, kitchen owners, or insurers if required.
Users may request data deletion, subject to legal retention requirements.

8. Prohibited Conduct
Users must not:
Misrepresent their identity, qualifications, or compliance status.
Use the platform for illegal activities or unauthorized food production.
Circumvent the platform’s payment or booking systems.
Engage in harassment, abuse, or fraudulent behavior.
Violations may result in account suspension or legal action.
9. Intellectual Property
All content on the Food Web platform is protected by copyright, trademarks, and intellectual property laws.
Users may not copy, modify, or distribute Food Web’s content without permission.
10. Accessibility Commitment
Food Web is committed to providing an inclusive platform for all users, including those with disabilities.
We follow Web Content Accessibility Guidelines (WCAG).
Users may request accommodations or support for accessibility-related concerns.
11. Amendments & Changes
Food Web may update these terms at any time.
Users will be notified of significant changes.
Continued platform use constitutes agreement to updated terms.
